Foodmall Application Services Ltd (RC: 1842366). takes the protection of users’ data very seriously, and is resolute to ensure that the personal data you provide to us when visiting our app is safe and secured from breaches.
We therefore take it as a responsibility to properly manage your personal information and use it only for the purpose of ensuring an easy access, utilization and delivery of the goods and services that we offer. This Policy describes and explain how Foodmall Application Services Ltd. processes your personal data.
Foodmall Application Services Ltd (“Foodmall”, “we”, “us”, “our”) is a food ordering and delivery technology company that connects its users to request and purchase food, drink and entertainment services from vendors and have them delivered to their desired location, picked up or offered as a subscription service (“Services”). At Foodmall, here’s how we collect, use and share your personal information. Personal information means information that identifies you and includes information such as your name, email address, telephone number as well as any other personal data collected. We recommend that you read this Privacy Policy carefully to understand your rights and our duties towards managing your personal data in addition to our Terms of Service. Cookies Policy
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

1. The Information We Collect
The lawful basis for processing your data is the performance of our contractual obligations to you. The information we collect and process in order to fulfil our contractual obligations to you includes your: name, residential and contact address, telephone number, email address, bank details, posts on social media if you access us through Facebook, location, photograph, IP address, MAC address, IMEI number, IMSI number and other information relevant for the processing of your request.

2.1. Buy a food & beverage product or service from us.
2.2. Register for a specific product or service (such as registering your name, phone number, email address and physical address details for any of our services).
2.3. Subscribe to newsletters or other services from us.
2.4. Ask us for more information about a product or service or contact us with a question or complaint.
2.5. Take part in a promo or survey.
2.6. Use our application and its affiliated services.
2.7. Visit or browse our website or other platforms.
3. Notification of Changes to our Privacy Policy
This Privacy Policy is reviewed annually to ensure compliance with applicable data protection laws and regulations in all cities we operate and jurisdictions where the Foodmall service(s) are provided, including but not limited to the Nigeria Data Protection Act (NDPA). Due to the nature of our technology, user demands and industry advancements, we might add new features and functionality. In cases of change in law and policy, our data protection practices will adapt to new policies and we will update this Privacy Policy statement to describe our new practices and publish them on our platform (which is the official website, ordering portal and mobile app).
4. How We Collect and Use Your Data
Foodmall collects the above-mentioned information using web browser cookies, GPS device location, google maps and services location, JWT, web tokens. The cookies assist us to ensure that correct and complete orders are submitted for better service delivery, and also enable us to remember your IP address when next you access our app. When you browse or access our website and log on to our app, we may retain that information in order to respond to your inquiries, process your request, and reach you through your address for delivery of your orders. This means that our servers would automatically record information that your browser sends whenever you visit a website.
We use the above-mentioned information for marketing, payment, home delivery services, research, analysis and vendor registration.
5. Consent and Access Rights
We require your consent for the processing of your data to complete your request on our app. We use this information only for the purpose for which it was collected, and the information is stored on the internet for user preferences. Therefore by using the Foodmall app, it is given that you have consented to the processing of your data in the manner and for the purpose of buying and selling on our online platform.
We affirm that the consent sought and given by users through the use of our app is not to be utilized in any circumstance for the purpose of involving in, aiding or abetting any criminal acts and anti-social conducts.
You reserve the right to amend or modify your personal data at any time, although we do not undertake to update such information or change same in our server.
6. Personal Data Protection Principles
We confirm that we comply with the guidelines on use of personal data, and hence we would process your data lawfully, and only for specified, explicit and legitimate purposes. To this end, we also take user’s data that is adequate and relevant, and its use is limited to purposes for which it is obtained. The data collected is not kept in a form which permits identification of data subject by third parties, but stored on secured servers, which processes the data using appropriate technical and organizational measures to protect against unauthorized or unlawful processing or accidental divulge. Foodmall will not associate your data with any other data held by other hosting infrastructure.
7. User Responsibility
Users should get acquainted with this policy and must ensure that the information provided to us is complete, accurate and up to date, to facilitate hitch-free service on our app.
8. Data Security
Foodmall implements and maintains appropriate safeguards to protect personal data, taking into account in particular the risks to you, presented by unauthorized or unlawful processing or accidental loss. We use encryption and pseudonymisation to safeguard the personal data where appropriate. We uphold confidentiality principles in data protection, collection and analysis by ensuring that only those who are authorized to use personal data have access to it. We test-run and use third organisms checks to ascertain and confirm the integrity of the safeguards.
9. Third Party Access & Technologies
Foodmall would not share your personal information with any third party, unless we are obligated to do so to satisfy any applicable law, regulation, legal process or enforceable governmental request, enforce applicable terms of service, including investigation of potential violations, to detect, prevent, or otherwise address fraud, security or technical issues, or protect against imminent harm to the rights, property or safety of Foodmall app, its users or the public as required or permitted by law.
10. Violation of Privacy
In the unlikely event of a breach or violation of your privacy, we have put in place procedures to deal with any suspected personal data breach and will notify you of any personal data breach and let you know the steps we have taken to remedy the breach and the security measures we have applied to render your personal data unintelligible. Foodmall is not however responsible for any personal data breach which occurs as a result of an act or threats of terrorism; an act of God (such as, but not limited to fires, explosions, earthquakes, drought, tidal waves and floods) which compromises our data protection measures; war, hostilities (whether war be declared or not), invasion, act of foreign enemies, and the use of your personal data by a third party designated by you.
11. The use of cookies (Understanding what you want/User preferences)
We might use cookies and other techniques such as web beacons to collect information that makes our platform remember you and tells us how you use our website, web-related products and services.
This, in turn, helps us make our platform relevant to your interests and needs. They also help us find information once you have logged in or help us link your browsing information to you and your personal information, for example, when you choose to register for a service. We may use a persistent cookie (that stays linked to your browser or mobile browser cache) to record your details so we can recognise you if you visit our platform again.

13. Location Services
Before you can use our platform for the first time, we will ask you to choose whether to allow Foodmall to access your location and under what circumstances. Location services must be enabled for us to provide our services to you. You may change these settings at any time on your device. Once you allow us access your location, we will obtain your location through IP address, GPS, and other sensors that provide necessary information for the provision of our services.
Your privacy and information permissions and settings can be updated at any time on the Foodmall platform when you are logged into your account.
14. Direct marketing
We may occasionally contact you directly with related point-to-point restaurant information and special offers from us and other vendors. You consent to us sending you such information including by means of telemarketing, email, SMS and other digital channels, when you “Subscribe” to receive marketing communications from Foodmall. If at any time you decide you do not wish to receive marketing communications from us, you may click the “Unsubscribe” button in the marketing emails and messages or by emailing us. If you opt out of receiving marketing communications from us, we may still contact you or send you messages that are not of promotional nature, such as receipts for vendor’s directory and delivery services you booked through Foodmall.
15. Access and corrections to personal information
15.1. Under the law, you have the right to access, correct, amend, and delete your personal information or object to processing your personal information.
15.2. You may make any of the following requests in respect of your personal information within Foodmall custody:
a) Confirmation on the personal information we hold about you;
b) Access to the personal information we hold about you provided that such requests are made in compliance with the Freedom of Information Act and other applicable laws;
c) Correction of or updates to the personal information we hold about you;
d) Anonymization, blocking or erasure of your personal information that is no longer necessary in order for us to provide services to you or no longer necessary for our normal business operations and activities;
e) Data Portability. In some circumstances, you may, by express request ask us to provide a third-party vendor with a copy of the personal information we hold about you in a structured, machine-readable and commonly used format (as selected by us), or otherwise in accordance with the requirements of the applicable law;
f) Deletion or erasure of personal information we hold about you, where we relied on your consent to use your personal information unless an exception applies, such as where we are required to retain such information to comply with our legal or regulatory obligations;
g) Revoke your consent, where we rely on your consent to use and disclose your personal information;
You can make any of the above requests by contacting us via email at legal@foodmall.app. We may ask you to provide suitable identification when you seek to make any of these requests, to verify your identity.
We will provide you with a response as soon as possible. If we are unable to comply with your request for any reason (such as, not being permitted or required to do such an act under the privacy legislation in force) we will inform you of this.
If the information we provide in response to your request includes information that is the personal information of a third party, or that is confidential, or in which we own the copyright (such as transcripts or recordings of customer service call records), we may redact such information where reasonably necessary, and you must keep such information confidential and not make the information public, including by sharing the information on social media, without our written consent sought and obtained.
16. Data Protection & Compliance Officer (DPCO)
In compliance with the Nigeria Data Protection Act (NDPA) 2023, we have appointed a Data Protection Officer (DPO) responsible for overseeing our data protection strategy and implementation. 17. Governing law
This policy is governed by the laws of the Federal Republic of Nigeria. Where any provision of this policy is deemed inconsistent with a law, regulation or convention, such provision shall be subject to the overriding law, regulation or convention.
This policy shall be governed by the laws of the Federal Republic of Nigeria.
This policy applies to all users of the services provided by Foodmall, and to anyone else who contacts Foodmall or otherwise submits information to Foodmall.
